We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

To use the Bemando platform, you must:

• Be at least 18 years of age
• Be legally authorized to work in the jurisdiction where you seek employment
• Provide accurate and truthful information during registration
• Have a valid phone number capable of receiving calls and SMS messages

3. Service Description

Bemando is an AI-powered staffing platform that connects restaurant and hospitality candidates with businesses seeking workers. Our services include:

• Candidate registration and profile management
• AI-powered matching between candidates and available positions
• Automated phone interviews conducted by AI
• Shift notifications and scheduling via SMS and phone calls
• Availability management tools

Bemando is not an employer. We facilitate connections between candidates and restaurants. Employment relationships are between candidates and the hiring restaurants directly.

4. Account Terms

When you create an account on Bemando:

• You are responsible for maintaining the security of your account credentials
• You must provide accurate, current, and complete information
• You must promptly update your information if it changes
• You may not create multiple accounts or share your account with others
• You are responsible for all activity that occurs under your account

5. SMS and Call Consent

By registering on Bemando and providing your phone number, you expressly consent to receive:

• Automated AI phone calls for interview and verification purposes
• SMS messages regarding shift notifications, schedule changes, and account updates
• Phone calls from our system for shift confirmations and urgent notifications

Message frequency varies based on your activity. Standard message and data rates may apply. You may opt out of non-essential communications at any time by replying STOP to any SMS message or by contacting us directly. Opting out of essential communications may result in inability to use the Service.

6. User Conduct

You agree not to:

• Provide false or misleading information on your profile
• Accept shifts you do not intend to fulfill
• Use the platform for any unlawful purpose
• Harass, abuse, or harm other users or restaurant partners
• Attempt to interfere with or disrupt the platform's functionality
• Scrape, collect, or harvest data from the platform without authorization

7. Intellectual Property

The Bemando platform, including its design, features, content, and underlying technology, is owned by Bemando and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or its content without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Bemando shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes but is not limited to:

• Loss of income or employment opportunities
• Damages resulting from actions of restaurants or other users
• Service interruptions or data loss
• Errors in AI matching or automated communications

Bemando's total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Bemando (if any) in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Bemando does not guarantee that the Service will be uninterrupted, secure, or error-free, or that any specific results will be achieved through use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also delete your account at any time by contacting us. Upon termination:

• Your right to use the Service ceases immediately
• We may retain your data as described in our Privacy Policy
• Provisions that by their nature should survive termination will remain in effect

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bemando operates, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
